1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of LiveSync, operated by PT Mirai Kreasi Negeri ("LiveSync," "we," "us," or "our"), a company registered in Indonesia (NPWP: 42.633.711.9-013.000, NIB: 1207001650392).

By creating an account or using our platform, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use LiveSync.

We may update these Terms at any time. We will notify you of material changes via email or in-app notification. Continued use of LiveSync after changes constitutes acceptance of the updated Terms.

2. Description of Service

LiveSync is a software-as-a-service (SaaS) platform that enables content creators to:

• Build a customizable digital storefront (your "LiveSync Store")
• Sell digital products, online courses, memberships, and bookings
• Capture leads and grow their audience
• Manage contacts, broadcasts, and email automations
• Access analytics and audience insights

LiveSync provides tools and infrastructure. We are not responsible for the content creators publish, the products they sell, or the transactions between creators and their customers.

3. Accounts and Registration

Eligibility

You must be at least 18 years old to use LiveSync. By creating an account, you represent that you meet this requirement.

Account Responsibilities

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activity that occurs under your account
• Providing accurate and up-to-date account information
• Notifying us immediately of any unauthorized account access

One Account Per Person

Each person may maintain only one LiveSync account unless explicitly authorized by us in writing.

4. Subscriptions and Payments

Plans

LiveSync offers two subscription plans:

• Creator Plan — $29/month: Core platform features including store, digital products, bookings, courses, forms, contacts, and email broadcasts.
• Pro Plan — $99/month: All Creator features plus order bumps, discount codes, creator affiliate tools, advanced analytics, email automation, and priority support.

Billing

Subscriptions are billed monthly on the date you first subscribed. All prices are in USD. Applicable taxes may be added depending on your location — Polar handles all tax calculation and collection.

Cancellation

You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of your current billing period. You retain full access until that date.

Please refer to our Refund Policy for details.

Price Changes

We reserve the right to change subscription prices with 30 days' notice. Price changes will not affect your current billing period.

5. Creator Content and Stores

Your Content

You retain all ownership of content you upload to LiveSync, including product files, images, descriptions, and course materials ("Your Content"). By uploading content, you grant LiveSync a non-exclusive, worldwide license to host, display, and deliver Your Content solely to operate the platform.

Content Standards

You are solely responsible for Your Content. You agree not to upload or sell content that:

• Infringes any third-party intellectual property rights
• Is fraudulent, deceptive, or misleading
• Contains malware, viruses, or malicious code
• Is illegal in the United States, Indonesia, or the jurisdiction of your buyers
• Contains adult content, hate speech, or material that promotes violence

Creator Transactions

LiveSync provides the infrastructure for you to sell to your audience. You are responsible for fulfilling orders, handling customer inquiries, and complying with applicable consumer protection laws. LiveSync is not a party to transactions between you and your customers.

6. Prohibited Uses

You may not use LiveSync to:

• Violate any applicable law or regulation
• Impersonate any person or entity
• Transmit spam or unsolicited bulk communications
• Attempt to gain unauthorized access to any part of the platform
• Use automated tools to scrape, crawl, or extract data
• Interfere with or disrupt the platform's infrastructure
• Resell or sublicense LiveSync services without authorization
• Use the platform to facilitate pyramid schemes or multi-level marketing

Violation of these prohibitions may result in immediate account termination without refund.

7. Intellectual Property

LiveSync and its original content, features, and functionality are owned by PT Mirai Kreasi Negeri and are protected by intellectual property laws. The LiveSync name, logo, and trademarks may not be used without our prior written consent.

You may not copy, modify, distribute, or create derivative works from LiveSync's software, design, or documentation.

8. DMCA Safe Harbor & Copyright Complaints

LiveSync respects intellectual property rights and complies with the Digital Millennium Copyright Act (DMCA).

If you believe content on a LiveSync creator's store infringes your copyright, send a written notice containing:

• Your physical or electronic signature
• Identification of the copyrighted work claimed to be infringed
• Identification of the infringing material and its URL on LiveSync
• Your contact information (address, phone, email)
• A statement that you have a good faith belief the use is unauthorized
• A statement under penalty of perjury that the information is accurate and you are the copyright owner or authorized to act on their behalf

We will respond to valid DMCA notices by removing or disabling access to the allegedly infringing content. Repeat infringers will have their accounts terminated.

Counter-Notice

If you believe your content was removed in error, you may submit a counter-notice to the same address above.

9. Privacy

Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using LiveSync, you consent to our data practices as described in the Privacy Policy.

10. Disclaimers and Limitation of Liability

No Warranty

LiveSync is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied. We do not warrant that the service will be uninterrupted, error-free, or free of harmful components.

Limitation of Liability

To the maximum extent permitted by law, PT Mirai Kreasi Negeri and its officers, directors, and employees shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of LiveSync.

Our total liability to you for any claim arising from these Terms or your use of LiveSync shall not exceed the amount you paid to us in the 12 months preceding the claim.

Indemnification

You agree to indemnify and hold harmless PT Mirai Kreasi Negeri from any claims, damages, or expenses arising from your use of LiveSync, Your Content, or your violation of these Terms.

11. Termination

We may suspend or terminate your account at any time if you violate these Terms, engage in fraudulent activity, or for any other reason at our discretion with reasonable notice.

Upon termination, your right to use LiveSync ceases immediately. You may export your data for 30 days following termination. After that period, we may permanently delete your account data.

You may delete your account at any time from account settings.

12. Governing Law

These Terms are governed by the laws of the Republic of Indonesia. Any disputes shall be resolved through good-faith negotiation first. If unresolved, disputes shall be submitted to the courts of South Jakarta, Indonesia.

If you are a consumer in a jurisdiction with mandatory consumer protection laws, nothing in these Terms limits your statutory rights under those laws.
